1. About the Platform

SellMyOwnHome.ai ("the Platform") is a self-service software tool that assists Australian property owners in marketing and managing the private sale of their property. The Platform is operated in Australia and is not a licensed real estate agency. We do not provide real estate agent services, legal advice, or financial advice.

2. Eligibility

You must be at least 18 years of age and a resident of Australia to use this Platform. By creating an account, you confirm that you have the legal authority to sell or enquire about properties listed on the Platform.

3. Your Responsibilities

As a seller, you are solely responsible for:

• The accuracy of all property information and listing content
• Compliance with all applicable state and territory legislation
• Preparing and providing required legal documents (e.g., Contract of Sale, Section 32, Seller Disclosure)
• Engaging a qualified solicitor or conveyancer
• Ensuring your property sale meets cooling-off period requirements
• All negotiations and communications with potential buyers

4. No Agency Relationship

Use of the Platform does not create an agency, partnership, or employment relationship between you and SellMyOwnHome.ai. We act solely as a technology provider. All property transactions are conducted directly between the seller and buyer.

5. Compliance Guidance

The Platform provides state-specific compliance checklists as general guidance only. These checklists are not exhaustive and do not constitute legal advice. Requirements may change and vary by local council area. You must independently verify all legal requirements with a qualified professional.

6. Fees and Payment

Subscription fees are outlined on our Pricing page. All prices are in Australian dollars and include GST where applicable. Fees are non-refundable unless otherwise required by Australian Consumer Law.

7. Limitation of Liability

To the maximum extent permitted by law, SellMyOwnHome.ai is not liable for any loss, damage, or expense arising from your use of the Platform, including but not limited to failed property transactions, compliance failures, or third-party disputes. Our total liability is limited to the fees you have paid in the preceding 12 months.

8. Account Termination

We may suspend or terminate your account if you breach these terms, provide false information, or use the Platform for unlawful purposes. You may delete your account at any time by contacting support.

9. Governing Law

These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales.
